1. Agreement to Terms

By enrolling with Alchemy Breaking Academy, using our services, or opting in to receive SMS/text messages from us, you agree to be bound by these Terms.
If you do not agree to these Terms, you must not use our website, services, or SMS/text messaging program.
2. Eligibility and Use of Our Services
You must be at least 18 years old, or the age of majority in your jurisdiction, to enroll as an adult student or to provide consent as a parent/guardian for a minor student. You agree to use our website and services only for lawful purposes and in accordance with all applicable laws and regulations.
3. SMS/Text Messaging Program
Alchemy Breaking Academy offers an SMS/text messaging program (the “SMS Program”) for parents and adult students regarding enrollment and account‑related information. By providing your mobile number and giving consent (online or in person) when you enroll and agree to our Terms and Privacy Policy, you authorize us to send you SMS/text messages at the number you provided.
3.1 Types of Messages
Messages we send as part of the SMS Program may include:
Class schedule updates and reminders
Weather or holiday closures and urgent studio alerts
Important studio announcements and policy updates
Account and billing notifications
Occasional promotions or newsletters related to Alchemy Breaking Academy (no more than 4 messages per month)
We will not send messages for unrelated third‑party products or services.
3.2 Message Frequency
Message frequency will vary based on your enrollment status, class schedule, and account activity, but in general you can expect no more than 4 promotional or newsletter‑type messages per month, plus necessary transactional and service messages (such as schedule changes or closures).
3.3 Message and Data Rates
Message and data rates may apply to each SMS/text message sent or received, as determined by your mobile carrier. You are responsible for any charges imposed by your carrier for SMS/text messaging and data usage.
Consent to receive SMS/text messages is not a condition of enrollment, purchase, or participation in classes at Alchemy Breaking Academy.
3.4 Supported Carriers and Delivery
Message delivery is subject to your mobile carrier’s network availability and policies, as well as applicable A2P 10DLC and carrier regulations. We are not liable for delayed or undelivered messages.
4. Opt‑In and Opt‑Out
4.1 Opt‑In Methods
Parents and adult students may opt in to the SMS Program when they enroll online or in person by:
Providing a mobile phone number on our enrollment form, and
Affirmatively agreeing to receive SMS/text messages by accepting our Terms and Privacy Policy, which clearly describe our SMS Program and disclosures.
Any online forms we use for SMS consent will clearly state that message and data rates may apply and that you can reply STOP to opt out and HELP for help.
4.2 Opt‑Out Instructions
You may opt out of receiving SMS/text messages at any time by replying STOP to any message you receive from us. After you send STOP, we will send a one‑time confirmation SMS to confirm that you have been unsubscribed and you will no longer receive SMS messages from us, except as required by law or for confirming your opt‑out.
If you wish to rejoin the SMS Program after opting out, you may opt in again through our enrollment process or any other method we make available.

5. Privacy and Data Use

6. User Responsibilities
You represent and warrant that you are the current subscriber or authorized user of any phone number you provide to Alchemy Breaking Academy. You agree to promptly notify us if you change or deactivate your mobile number so we can update our records and avoid sending messages to a number that no longer belongs to you.
You are responsible for maintaining the accuracy of your contact information and for any charges incurred from your use of SMS/text messaging.
7. Prohibited Conduct
You agree not to:
Use our website, services, or SMS Program for any unlawful, fraudulent, or abusive purpose.
Interfere with or disrupt the operation of our systems or networks.
